Abstract
This article proposes to examine some of the main ideas in the thought of Professor Eugenio Raúl Zaffaroni in the field of criminal law punishment, and in relation to the role the judge has to play in that matter. The selected aspects of the work of Zaffaroni –only a few from the author’s vast and complex work–are critically examined, from a republican political philosophy’s point of view, this is, from a theoretical conception that accents ideals of self-government, the community and social integration.
