Abstract
This paper examines the existing problems regarding the structuring of corporate reorganizations in Argentina, with a special focus on the financing that is many times indispensable to ensure the success of these restructurings within the Argentine legal framework. The article describes and considers the main and typical sources of financing prevailing in the market, as well as the limitations when a company becomes increasingly insolvent and/or files for bankruptcy or reorganization. Lastly, the incentive structures generated by the Argentine bankruptcy and reorganization regime and their effects on a company’s prospects are examined, with especial regard for the limitations established by the regulations applicable to financing.
