Abstract
The principle of personal autonomy establishes that people can carry out all actions that are not prohibited nor affect third parties. Consequently, they have the right to freely choose their life plan. The state is not only prohibited from interfering in this area, but also has the duty togrant citizens all possible means to access the rights without restrictions. However, not all citizens have access to rights under the same conditions. The transvestite-trans collective has historically constituted an invisible and violated group. Their life is still marked by structural violence that causes marginalization and leads to a consequent restriction on access to the most fundamental rights. The present study starts from an emancipatory vision of the principle of personal autonomy and proposes to deepen into the limitations that the transvestite-trans collective has in its enjoyment.
