Abstract
In the last four years, the Supreme Court of Justice of the Nation has put a lock on the lawsuits that pursue the recognition of trade union rights in civil security forces. First, it denied that right to the police of the Province of Buenos Aires in April2017. After that, between August 2020 and May 2021, it dismissed four similar lawsuits filed by prison’s employees in Córdoba, Entre Ríos and Buenos Aires. Thus, hundreds of collective claims that were promoted and are being promoted by these groups remain in the realm of infringement and under the threat of severe penalties. This paper proposes a three-dimensional analysis of one of the most recent Supreme Court decisions, regarding the penitentiary’s employees in Córdoba. It begins with thorough legal examination of its normative premises, exposing serious interpretive errors in relation to international human rights standards.
