Abstract
This paper will analyze how the processes of selection and hiring of labor personnel, mainly those with artificial intelligence (AI), can incur in discriminatory actions, contrary to the notion of structural equality. In addition, what will also be carried out is the assessment of arguments and consequent determination of whether the application of labor or civil law is appropriate; decision that is interesting due to its different points of view, principles, rules and dynamics.
