Abstract
The present research work identifies in the first instance the modifications introduced through the creation of the constitutional block of 1994 through art. 75 paragraph 22 of the CN, and the consequent hierarchy of international instruments focused on human rights and their relationship with the protective framework of the Right to health as a fundamental prerogative of the human person. In a second instance, we will see some iconic cases in relation to the matter under study, and consequently, the interpretation of the highest court in the protective recognition of this fundamental right over time, under the jurisprudential analysis of the following rulings: Saladeristas of Barracas
