Abstract
The purpose of this article is to determine what are the powers available to the figure of the complaint in the national procedure. Specifically, the particularities of the figure under analysis, specifically when, from the determination of the investigated procedural object, the injury to a subjective right can be considered. In this understanding, a brief mention will be made of the new ritual ordering of progressive implementation (L. 27.063) and the preponderant role that the victim obtains in it, without overlooking the fact that, with greater rights, greater duties and obligations assist the litigant. Finally, throughout the article it will be verified how the jurisprudential source of our CSJN has acted in order to lay the foundations of the prevailing ritual regulations.
