Abstract
Antitrust defense in Brazil has been established since 1962 through Law 4,317/1962, however, only with the entry into force of Law 8,884/94 did antitrust law become relevant, considering that CADE was transformed into an autarchy, with the establishment of fixed mandate to its members and, consequent expansion of their autonomy. The applicability of the Antitrust Law has always been controversial in relation to the Financial system and the subject of intense discussions about which authorities have the competence to examine acts of concentration involving financial institutions, which led the AGU, after being instituted, to suppress or dispute involving CADE and BACEN.
