Abstract
The present study aims to analyze the fatigue society according to Byung-Chul Han's theory with conceptual aspects regarding the right to disconnect and the possibility of its recognition by the courts as a personality right within such a society. establish a direct relationship between the tiredness society and personality rights, the first being that arising from the hyperconnectivity, hyperconnection, hyperproductivity and hyperinformation provided by the constant use of technology, which exhausts the worker and raises the question about his right to disconnection nowadays. As a methodology, scientific and qualitative research is used, with the application of the deductive-logical and dialectical method for its development.
